Terms of Use (End User License Agreement) — Photo Cleaner: Swipe Wipe

These Terms of Use ("Terms") govern your use of the Photo Cleaner: Swipe Wipe mobile application ("Photo Cleaner", "the app"). By downloading or using the app you agree to these Terms. If you obtained the app through the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to the extent it is not inconsistent with these Terms.
1. What the app does
Photo Cleaner helps you review and organize the photo and video library on your device. All processing happens on your device; the app does not upload, back up, or store your photos anywhere.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the app store's usage rules.
3. Deleting media — your responsibility
The app is a tool for deleting photos and videos you choose to remove:
Nothing is deleted without your explicit confirmation through the operating system's own deletion dialog.
Deleted items may remain in your system's "Recently Deleted" album for a limited time (as controlled by your operating system), after which they may be permanently unrecoverable.
You are solely responsible for reviewing what you delete. To the maximum extent permitted by law, we are not liable for the loss of any photos, videos, or other data resulting from deletions you confirm.
We recommend keeping an independent backup of anything important.
4. Free features and Photo Cleaner Pro
The free version lets you browse, review, and organize your library. Deleting media (including swipe-to-delete and duplicate merging) requires an active Photo Cleaner Pro subscription.
Subscriptions
Pro is offered as auto-renewing subscriptions (currently monthly and annual). Prices are shown in the app in your local currency before you buy and are charged to your app store account.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
You can manage or cancel your subscription at any time in your device's app store subscription settings. Deleting the app does not cancel a subscription.
Previous purchases can be re-activated with "Restore Purchases" on the paywall.
Payments and refunds are handled by the app store, not by us. Refund requests must be made through the store (for Apple: reportaproblem.apple.com).
5. Acceptable use
You agree not to reverse engineer, modify, resell, or redistribute the app; not to use it in violation of any law; and not to interfere with the services that support it.
6. Intellectual property
The app, its design, and its content (excluding your media) are owned by the developer and protected by applicable intellectual-property laws. Your photos and videos remain entirely yours — the app claims no rights over your media.
7. Privacy
Our Privacy Policy describes what limited data the app collects and how it is used. It forms part of these Terms.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the app will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data (including deleted photos or videos), profits, or goodwill, arising out of or related to your use of the app. Our total aggregate liability for any claim shall not exceed the amount you paid for the app in the twelve months preceding the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Termination
You may stop using the app at any time. We may suspend or terminate the license if you materially breach these Terms. Sections 3, 6, 8, 9, 11, and 12 survive termination.
11. Apple App Store terms
If you obtained the app through the Apple App Store, the following additional terms apply:
Parties. These Terms are concluded between you and the developer only — not with Apple Inc. ("Apple"). The developer, not Apple, is solely responsible for the app and its content.
License scope. The license granted to you is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing).
Maintenance and support. The developer is solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services.
Warranty. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the developer's responsibility.
Product claims. The developer, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including (i) product liability claims, (ii) any claim that the app fails to conform to an applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property claims. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual-property rights, the developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Governing law
These Terms are governed by the laws of the developer's country of residence, without regard to conflict-of-law rules, except where the mandatory consumer-protection law of your country of residence applies.
13. Changes to these Terms
We may update these Terms from time to time. The current version is always available at this page; the effective date above reflects the latest revision. Continued use of the app after changes take effect constitutes acceptance.
